GENERAL TERMS OF USE OF HL-TOPMIX LTD WEBSITE

Any person, hereafter called “User”, who has received access to the website: https://hl-topmix.com/bg, hereafter called “website”, and to the information and services in it, further referred to as “Content”, offered by HL-TopMix Ltd, agrees to and accepts the following General Terms of Use.  

The user of this website shall observe these General Terms, as well as all regulations of the Bulgarian and international legislation. In case of disagreement with the General Terms, the user shall cease the use of the website immediately. HL-TopMix Ltd shall not be liable, if the user has not been acquainted with the present terms. 

I. General Provisions

Please read carefully the present General Terms of Use prior to using the website of HL-TopMix Ltd (called hereafter “HL-TopMix”). These general terms shall represent a contract between you and HL-TopMix, which grants you the right to use free of charge the services of the website for personal and non-commercial purposes, observing the terms as below. The present general terms shall be binding in terms of the relationships between you, as a user of the website services, and HL-TopMix. By accessing the webpages, you agree to be bound by the present general terms and any further changes in them, and you shall commit to observe them. In case that you disagree with all general terms stipulated as below, please do not use HL-TopMix website.

II. Main definitions

Under the present General Terms, the definitions listed are used in the following meaning:

 “USER” denotes any natural person using one or more of the HL-TopMix website services.

 “SERVICE/S/” include:  

• Access to the provided through the web browser information resources/ website data;  
• Receipt of an e-mail bulletin by the users registered for the service “Subscribe”;
• Receipt of an e-mail or phone call by the users registered for the service “Inquiry”.

"PARTNER" is any person who is in contractual relationships with HL-TopMix, entitled to provide additional information for their services/goods to the registered Users of the website, who have previously agreed to that.

"THIRD-PARTY CIBER ATTACKS (MALWARE ATTACKS)" – actions or inactions of third parties contradicting the internet ethics rules, including but not limited to DoS (Denial of Service – server overload), server infiltration, deface, data theft, and etc.

"DIRECT MARKETING" – offering services and goods to Users via conventional post service or e-mail, by phone or another direct method. 

III. Copyright

1. All rights reserved. All intellectual property rights over the information resources and materials published on the website are subject to protection by the Copyright and Related Rights Act, and the unauthorized use of those rights constitutes legal offence and shall result in civil, administrative penalty or penal liability in accordance with the Bulgarian laws in force.
2. Creative Commons. Part of the materials on the website may be used under the terms of Creative Commons license. These materials will be specifically marked.
3. Use of RSS feeds. RSS feeds are XML files, which serve for automatic aggregation of content from other sites whose address is indicated in the metadata of each HL-TopMix page. They contain title, author, photo and the first 500 (five hundred) symbols of the article. They can be republished or aggregated in other sites without requiring express permission. Any publication in a format different from a website format (e.g. public screen) requires the written permission of HL-TopMix. If other sites use the attached in the RSS feed photo, they should, in all cases, quote also the title, the first 500 symbols of the text and the author.  

IV. Confidentiality

HL-TopMix is a personal data administrator, registered under the Personal Data Protection Act. In connection with the use of the services of our sites, we process personal data at the terms of our Confidentiality Policy, which you can access here. The policy represents an integral part from the General Terms.  

HL-TopMix commits to ensure the inviolability of the information containing personal data, provided by the users online via the registration applications. Disclosure of the said data may occur only in cases when the user themselves have submitted the data in spaces with public information of the registration form, and on the page Settings, or when the information is requested by state bodies or officials, legally authorized to demand and collect information containing personal data, observing the legally stipulated rules. 

HL-TopMix may provide the statistical data collected regarding the website attendance to advertisers/ advertising agencies, which keep statistics of the clicks, and other actions of the users performed on their advertising banners and links, to prepare internal statistics. Your data will be used for the purposes of Direct Marketing only with your express consent stated when registering, or after making changes in the settings of your own profile.

The notification regarding changes in the registration terms, the General Terms of Use for the websites, the Declaration of confidentiality or the Rules for Use of the forums is not considered to be direct marketing.

V. Disclaimer

HL-TopMix makes all possible efforts to maintain true, correct and up-to-date information on its site, without excluding the possibility of occurrence of any incidental objective inconsistencies or omissions. HL-TopMix shall not be liable for any consequences, including eventual damages, arising from or related to, in any way, the access, use or inability to use this site. The information contained in this website is provided in compliance with the Bulgarian laws in force, without a warranty by HL-TopMix for its inviolability or safety from cyberattacks of third parties.

HL-TopMix shall not be responsible for subjective perceptions or interpretations of the accuracy, completeness or usefulness of the information resources on this site.

HL-TopMix shall not be responsible for the information (including its completeness or authenticity), contained in websites to which the present site contains references/links.

HL-TopMix shall be entitled to compensation for any damages, expenses or claims by third parties, resulting from breach of these general terms and/or unauthorized use of the services of the site.

VI. Services requiring registration

HL-TopMix reserves its right to provide access to certain range of services against compulsory free-of-charge registration. The services provided are:

• Receipt of e-mail bulletins of HL-TopMix publications by the users who have registered for the service “Subscribe”.
• Access to PDF files with the entire content of the paper-based editions of the magazines, by the users who have subscribed for the service and/or for the paper edition.

HL-TopMix reserves its right to cease the provision of the above-listed free-of-charge services via notification on its website.

VII. Changes

HL-TopMix reserves its right to make changes in the present General Terns at any time, by prompt publication of these changes on its site, together with a notification regarding the changes in the General Terms.

For any matter unsettled by the present General Terms, the operative Bulgarian laws shall apply.

The present General Terms were approved with a resolution of the Board of Directors of HL-TopMix Ltd and enter in force starting from May 23rd, 2018.
